LEGAL CONSTRUCTION AND IMPLICATIONS RELATED TO PROTECTION OF MAKING SEX TAPE WITH A COUPLE

This study aims to analyze the Indonesian laws and regulations concerning protection of intimate video makers. The research was conducted by analyzing Pornography Law, Information Electronic Transaction Government Regulation on Implementation Systems, Minister Communication Personal Data Protection. found that data/documents are made for oneself their own interests which not prohibited law included one privacy rights must be protected every human being state. making this is in enjoy life should contested. Activities contained can range from holding hands, hugging, kissing having sex with consent. Penelitian dilakukan dengan Undang-Undang Pornografi, Informasi dan Transaksi Elektronik, Peraturan Pemerintah Penyelenggaraan Sistem Elektronik serta Menteri Komunikasi Perlindungan Pribadi. menemukan bahwa data/dokumen dibuat diri sendiri kepentingan bukanlah hal dilarang oleh undang-undang justru harus dilindungi baik tiap manusia maupun negara. Pembuatan mesra termasuk dalam hak pribadi menikmati hidup tidak boleh diganggu gugat. Aktivitas termuat tersebut bisa dari bergandengan tangan, berpelukan, berciuman hingga berhubungan badan atas persetujuan. Oleh sebab itu jika terdapat pelanggaran seperti perolehan penyebarluasan tanpa persetujuan, pemilik dapat mengajukan gugatan kerugian permohonan menghapus tersebut.
